Article 2 – Purpose of the Operation:
The Operation is organized as part of the marketing of 1200 Énergie Fruit Christmas gift sets distributed in supermarkets.
A winning or non-winning ticket has been inserted inside each participating gift set.
Only one winning ticket was randomly inserted among the 1200 participating gift sets during their packaging.
This winning ticket allows its holder to receive an Énergie Fruit e-gift card worth €100 (incl. VAT), subject to compliance with the conditions defined in these rules.
The purchase or receipt of a participating gift set does not guarantee receipt of the prize.
No additional draw will be held. The winning or non-winning nature of the gift set depends exclusively on the ticket inserted inside it during its packaging.
Article 3 – Duration of the Operation:
The gift sets participating in the Operation will be sold from 09/15/2026, within the limits of available stock from participating distributors.
The provisional end date for sales is set for 12/31/2026.
The Organizing Company does not control the exact date of shelf placement or sale of each gift set by the different distributors.
The holder of the winning ticket must claim their prize no later than 11:59 PM on 03/31/2027, Paris time.
Any initial request sent after this date cannot be taken into account, unless a malfunction attributable to the Organizing Company prevented the winner from submitting their request within the specified period.
The email sending date will serve as proof for assessing compliance with the claim deadline.
Article 4 – Participating gift sets:
The Operation concerns exclusively the following Énergie Fruit Christmas gift sets:
Gift set name: Routine Gift Set – Curl Favorites
Internal reference: 260040 – V2
EAN code: 3701792600405
Number of participating gift sets: 1200
Other Énergie Fruit gift sets and products not expressly mentioned in this article do not participate in the Operation.
Article 5 – Persons who can claim the prize:
The prize can be claimed by any natural person of legal age residing in Metropolitan France, including Corsica, who has purchased or received as a gift one of the participating gift sets and discovered the original winning ticket.
If the winning ticket is discovered by a minor, the request must be made by their legal guardian.
Excluded from the Operation are:
- The directors, employees, and representatives of BLOOMUP;
- Persons who have directly participated in the design, organization, printing, or packaging of the Operation;
- Members of their household.
The gift set receipt is not required, as the gift set may have been received as a gift.
Only one prize can be awarded within the framework of the Operation.
No subscription to the Énergie Fruit newsletter is necessary to claim or receive the prize.
Article 6 – Identification of the winning ticket:
Each participating gift set contains a ticket indicating whether it is winning or non-winning.
The winning ticket contains a unique winning code allowing the Organizing Company to verify its authenticity.
To be considered valid, the winning ticket must:
- Be an original ticket issued as part of the Operation;
- Contain the unique winning code corresponding to the Operation;
- Not have already been used;
- Not have been reproduced, falsified, modified, or obtained fraudulently;
- Be sufficiently legible to allow for verification.
A non-winning ticket does not allow claiming the prize.
Unintentional damage to the winning ticket does not automatically deprive its holder of the prize. In case of a damaged ticket or partially illegible code, the holder is invited to contact the Organizing Company by attaching photographs allowing, as far as possible, to authenticate the ticket.
Article 7 – Prize claim procedure:
The holder of the winning ticket must claim their prize no later than 11:59 PM on 03/31/2027, Paris time.

The email subject must be:
"Christmas Gift Set – Winning Ticket"
The email must include:

- A complete and legible photograph of the winning ticket.
The request must be sent from the email address where the holder wishes to receive the e-gift card.
No online form needs to be filled out.
No payment, bank details, credit card number, or password will be requested to receive the prize.
The name, first name, postal address, and phone number of the ticket holder are not necessary for the normal processing of the request.
The holder must keep the original ticket until the final validation of their prize and receipt of their e-gift card.
The Organizing Company may request the presentation or sending of the original ticket only when additional verification is objectively necessary, particularly in the following situations:
- Illegible or incomplete winning code;
- Serious doubt regarding the authenticity of the ticket;
- Conflicting requests concerning the same code;
- Substantiated suspicion of reproduction or falsification;
- Prior use of the code.
If the original ticket is requested, the sending procedures will be communicated to the holder by email.
Reasonable costs directly related to this shipment will be reimbursed by the Organizing Company, upon presentation of proof.
When a request has been made before the deadline but is incomplete, the Organizing Company will send an email requesting the necessary additional information.
The applicant must respond within a maximum of 31 calendar days from the date this request for additional information is sent. In the absence of a response within this period, the Organizing Company may close the request after sending a final reminder.
Article 8 – Verification and validation of the prize:
Upon receipt of the email, the Organizing Company will notably verify:
- The unique winning code;
- The photograph of the winning ticket;
- The correspondence between the code and the one registered by the Organizing Company;
- The apparent authenticity of the ticket;
- The absence of prior use of the code;
- Compliance with the claim deadline;
- Compliance with the other conditions of these rules.
Once the request is complete and valid, the Organizing Company will confirm the prize validation by email.
In case of refusal of the request, the Organizing Company will inform the applicant by email and indicate the reason for the refusal.
Any refusal must be based on objective elements, such as:
- A non-existent code or one that does not match the winning code;
- A code that has already been used;
- A ticket that is clearly reproduced or falsified;
- A request sent after the deadline;
- Failure to provide the necessary verification elements;
- Established fraud or attempted fraud.
The Organizing Company cannot refuse a request based solely on unsubstantiated suspicion.
Article 9 – Prize delivery:
After final validation of the prize, the €100 (incl. VAT) e-gift card will be sent to the email address used to make the request.
The prize will be sent within a maximum of 10 working days following the final validation of the prize.
The winner is advised to check their junk mail or spam folder if they do not receive the e-gift card within this timeframe.
In case of technical difficulty or inability to receive or use the e-gift card, the winner may contact the Organizing Company at: hello@bloomup.fr
The Organizing Company will implement reasonable means to enable the legitimate winner to receive and use their prize.

It cannot be resold.
Loss, theft, or communication of the e-gift card code to a third party after its issuance is the winner's responsibility, except in case of malfunction or fault attributable to the Organizing Company.
In the event of the definitive closure of the energie-fruit.com website before the e-gift card's expiration date, the Organizing Company will offer the winner an equivalent solution.
Article 11 – No prize substitution:
The winner cannot request that the e-gift card be replaced by:
- A sum of money;
- A bank transfer;
- A check;
- A specific product;
- Another prize or benefit.
The prize is awarded to the legitimate holder of the winning ticket, after verification of their request.
The winner may, however, use the e-gift card to have an order delivered to another person, subject to compliance with the general terms and conditions of sale of the energie-fruit.com website.
Article 12 – Fraud and competing claims:
Any reproduction, falsification, modification, or fraudulent use of the winning ticket or winning code may result in the refusal of the claim.
The Organizing Company may carry out strictly necessary verifications to protect the integrity of the Operation and prevent multiple prize awards.
In the event of competing claims for the same winning code, the Organizing Company may ask the persons concerned to present or send the original ticket and any useful elements to resolve the situation.
The prize will be awarded to the legitimate holder of the original winning ticket after examining the available elements.

"Christmas Box – Winning Ticket"
No provision of these rules may have the effect of excluding or limiting a liability that could not legally be excluded or limited.

The Organizing Company may modify, suspend, postpone or cancel all or part of the Operation only in the event of:
- Force majeure;
- Significant fraud;
- Serious technical malfunction;
- Legal or regulatory obligation;
- External circumstance making the normal continuation of the Operation impossible.
